WHAT TO EXPECT IN MEDIATION - A quick read

Mediation is a confidential, informal process where an impartial mediator helps parties resolve disputes through dialogue and negotiation — without a judge or jury. Here’s what you can expect:

  • Neutral Facilitation – The mediator doesn’t take sides or make decisions. Instead, they guide the discussion and help both parties work toward resolution.

  • Joint & Private Sessions – Some parts of the mediation may include everyone, while others involve private breakout sessions with just one party and the mediator.

  • Flexible Format – Mediation may be held virtually (via Zoom) or in-person. The process remains structured, but adaptable to the needs of the case.

  • Voluntary Agreement – No resolution is imposed. Any agreement reached must be mutually accepted by all parties involved.

  • Confidential Process – Everything shared in mediation stays private and cannot be used in court or arbitration.

FREQUENTLY ASKED QUESTIONS - Answered

  1. Is mediation confidential?
    Yes. Everything shared in mediation — including offers, admissions, and discussions — is confidential and cannot be used in court.
  2. Do we have to settle the case in mediation?
    No. Settlement is voluntary. The mediator helps you explore options, but no one is forced into an agreement.
  3. Can my attorney attend the mediation?
    Absolutely. Parties may attend with their legal counsel, and in most cases, this is encouraged.
  4. What happens if we can’t reach a settlement?
    If no resolution is reached, the case can proceed to litigation or arbitration. Sometimes, mediation helps clarify issues even if a deal isn’t finalized.
  5. What if I have technical trouble joining the Zoom mediation?
    If you get disconnected, simply re-click the original meeting link to rejoin. For assistance, contact the case manager at 602.786.8836.
